One of the easiest ways to experience the thrill of thoroughbred racehorse ownership is by using the services provided by an Approved Syndicate Promoter.
An approved syndicate promoter (promoter) is an individual or entity that has been granted an Australian Financial Services Licence (AFSL) by the Australian Securities and Investments Commission (ASIC). Furthermore, the promoter has also been accepted by Racing Victoria and ultimately placed on Racing Victoria’s Register of Approved Promoters (register).
As the appointed Lead Regulator of Victorian-based horse share and syndicate promotions under its co-regulation agreement with ASIC, Racing Victoria has the role of overseeing these promotions and consequently reviews each Product Disclosure Statement (PDS) which is lodged by each promoter prior to offering shares in these syndicates.
The promotion of syndicates and the offering of shares in horses is commonplace and from an industry development perspective, Racing Victoria is committed to encouraging horse ownership through commercial syndications as well as through informal industry networks. However there is often confusion about when promoting a syndicate or offering a share in a horse requires approval from ASIC or Racing Victoria and if so, the nature and limitations of that approval.
Accordingly, Racing Victoria has published an Industry Communiqué that interprets the provisions of the Corporations Act 2001 which is the Act that governs the promotion of horse syndicates and share offerings.
